Rental Agreement Template

This template is auto-completed and attached to every confirmed booking on RentOM. Both parties agree to its terms at the time of booking confirmation.

1. Item being rented

The item described in the RentOM listing referenced in this booking, in the condition declared by the Owner at the time of listing.

2. Rental period

Begins at handover (date/time confirmed in-app) and ends at return (date/time in-app). Late returns incur a fee equal to the daily rate × the number of days late, plus a 25% late penalty.

3. Fees

  • Rental fee at agreed daily/weekly/monthly rate
  • Handler fee (if Handler service was selected)
  • Refundable security deposit (released within 72 hours of return)

4. Renter responsibilities

  • Use the item only for its intended purpose and in accordance with the listing's Rules.
  • Take reasonable care to prevent loss, theft, or damage.
  • Return the item in the same condition received, less normal wear.
  • Report any damage immediately via the RentOM app.

5. Owner responsibilities

  • Deliver the item in the condition described in the listing.
  • Provide all listed accessories and instructions.
  • Not interfere with the Renter's use during the rental period (except where Handler service applies).

6. Damage & loss

If the item is damaged, lost, or stolen during the rental period, the Renter authorizes RentOM to deduct documented repair or replacement costs from the security deposit. Costs exceeding the deposit may be pursued through RentOM mediation and, if unresolved, the courts of the Owner's province.

7. Cancellation

  • Renter cancels > 7 days before start: full refund minus service fee.
  • Renter cancels 2–7 days before: 50% refund of rental fee; full refund of deposit.
  • Renter cancels < 48 hours before: no refund of rental fee; full refund of deposit.
  • Owner cancellations: full refund + 10% credit toward a future booking.

8. Liability waiver

Renter uses the item at their own risk. Owner and RentOM are not liable for injury or damage to the Renter or third parties arising from use of the item, except where caused by Owner negligence in disclosing the item's condition.

9. Governing law

This agreement is governed by the laws of the Province of Ontario, Canada, unless both parties reside in another province, in which case that province's laws apply.

10. Acceptance

Both parties accept these terms by confirming the booking in the RentOM app. The booking confirmation timestamp serves as electronic signature.
